AGREEMENT TO TERMS
 
By accessing or using any service provided by Turntopia LLC ("we," "our," or "us"), including Unmap, Blocktopia, and other applications (collectively "Turntopia services" or "our services"), you agree to be bound by these Terms of Service ("Terms").
 
If you disagree with any part of these Terms, you may not access or use our services.
 
These Terms apply to all Turntopia services, whether accessed via mobile application, website, or any other platform.

1. ACCEPTANCE OF TERMS
 
By creating an account or using Turntopia services, you represent that:
 
• You are at least 13 years of age (or older if required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You will not use the services for any unlawful purpose
• You have read and agree to our Privacy Policy
 
If you are under 18, your parent or legal guardian must review and agree to these Terms on your behalf.
 
If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

2. ELIGIBILITY AND ACCOUNT CREATION
 
Age Requirements:
 
• Minimum age: 13 years old (United States, COPPA compliance)
• EU/EEA: May be 14, 15, or 16 depending on your country's GDPR requirements
• Other jurisdictions: Must meet local age requirements for consent
 
You must not create an account if you are under the minimum age for your jurisdiction.
 
Account Creation:
 
• You must provide accurate and complete information when creating an account
• You must provide either a valid phone number OR email address (not both required)
• You may choose phone authentication (SMS) or email authentication
• You are responsible for maintaining the confidentiality of your account credentials
• You must immediately notify us of any unauthorized use of your account
• You are responsible for all activities that occur under your account
 
Single Account Policy:
 
• You may only create one personal account
• You may not create multiple accounts to evade bans, restrictions, or for fraudulent purposes
• Organizations may create dedicated organizational accounts with our approval
 
Account Verification:
 
• We may require verification of your identity, age, or contact information
• Failure to provide verification may result in account suspension or termination

3. USER ACCOUNTS AND SECURITY
 
Account Security Requirements:
 
• You must use a strong password (minimum 8 characters, including uppercase, lowercase, and number recommended)
• You must not share your account credentials with others
• You are responsible for all actions taken using your account
• Enable two-factor authentication if available for enhanced security
 
Account Responsibility:
 
• You are solely responsible for activity on your account
• You must maintain control of your registered phone number or email
• You must notify us immediately if you lose access to your authentication method
• We are not liable for losses due to unauthorized account access if you failed to maintain security
 
Account Transfer:
 
• Accounts are non-transferable
• You may not sell, trade, or give away your account
• Violations may result in account termination

4. ACCOUNT AUTHENTICATION OPTIONS
 
Choice of Authentication Method:
 
You must provide either a valid phone number OR email address for account creation. You are not required to provide both.
 
**Phone Authentication (Optional):**
• If you choose phone authentication, you will receive SMS messages with one-time passwords (OTP)
• You expressly consent to receive SMS messages for authentication purposes
• Standard message and data rates may apply from your carrier
• See Section 5 for complete SMS Terms and Conditions
 
**Email Authentication (Optional):**
• If you choose email authentication, you will receive verification links via email
• No SMS charges apply
• You can switch authentication methods in Settings
 
Phone Number Maintenance:
 
• If using phone authentication, you are responsible for maintaining access to your registered phone number
• You must notify us immediately if you lose access to your phone number: admin@turntopia.net
• We cannot guarantee account recovery if you lose access to your authentication method
 
Switching Authentication Methods:
 
• You can switch between phone and email authentication in Settings → Account → Authentication
• May require verification of your identity
• Changes take effect immediately

5. SMS COMMUNICATIONS
 
Note: This section only applies if you choose phone authentication. Email authentication is available to avoid SMS charges.
 
By Providing Your Phone Number for Authentication:
 
If you choose phone authentication, you consent to receive SMS messages for authentication purposes only:
 
• You will receive one-time passwords (OTP) for account verification
• Message frequency varies based on login activity (typically 1 message per request)
• Standard message and data rates may apply from your carrier
• Messages are sent through Twilio (third-party SMS provider)
• Messages are transactional only, not promotional
 
Opt-Out:
 
• You can opt-out by replying STOP to any message
• Opting out will prevent phone authentication
• You can switch to email authentication to maintain account access
 
Support:
 
• Reply HELP to any message for support information

Compliance:
 
SMS services comply with: TCPA (Telephone Consumer Protection Act), CTIA Messaging Principles, and carrier guidelines.

6. USER CONDUCT AND PROHIBITED ACTIVITIES
 
You agree NOT to:
 
**Harmful Content and Behavior:**
• Create false or misleading events
• Post defamatory, harassing, or abusive content
• Bully, harass, or threaten other users
• Post content that incites violence or hatred
• Share sexually explicit, pornographic, or obscene content
• Post content involving minors in inappropriate contexts
• Promote self-harm or dangerous activities
 
**Illegal Activities:**
• Violate any applicable laws or regulations
• Engage in fraud, scams, or deceptive practices
• Facilitate illegal drug sales or other criminal activity
• Infringe on intellectual property rights
• Distribute malware, viruses, or harmful code
 
**Privacy Violations:**
• Collect or harvest user information without consent
• Share others' personal information without permission (doxxing)
• Impersonate others or misrepresent your identity
• Create fake profiles or use stolen identities
 
**Platform Abuse:**
• Spam or send unsolicited communications
• Use automated systems (bots, scrapers) without permission
• Interfere with the service's operation or infrastructure
• Attempt to gain unauthorized access to systems or accounts
• Bypass security measures or access controls
• Manipulate metrics (fake likes, follows, engagement)
 
**Commercial Misuse:**
• Use services for unauthorized commercial purposes
• Sell or resell access to services
• Use services for multi-level marketing, pyramid schemes, or similar
 
**Circumvention:**
• Create new accounts to evade bans or restrictions
• Use VPNs or proxies to bypass geographic restrictions (unless for legitimate privacy purposes)
• Attempt to reverse engineer our software or services
 
Consequences of Violations:
 
• Content removal
• Account warnings or restrictions
• Temporary suspension
• Permanent ban
• Legal action if applicable
• Cooperation with law enforcement

7. CONTENT STANDARDS
 
All content you post must:
 
• Be accurate and truthful
• Not violate any third-party rights (copyright, trademark, privacy, publicity)
• Comply with these Terms and our Community Guidelines
• Be appropriate for a diverse global audience (ages 13+)
• Respect cultural sensitivities and diversity
 
Event Content Requirements:
 
• Event information must be accurate (date, time, location, description)
• Event images must be relevant and appropriate
• You must have rights to all content you upload
• You must not create events for illegal activities
 
User-Generated Content:
 
• You retain ownership of content you create
• By posting, you grant us a license to use, display, and distribute your content (see Section 9)
• You represent that you have rights to grant this license
• We may use your content for service operation, promotion, and improvement
 
Content Moderation:
 
• We reserve the right to review, remove, or hide content that violates these Terms
• Automated systems and human reviewers may moderate content
• You can appeal moderation decisions (see Section 13)

8. EVENT CREATION AND MANAGEMENT
 
Event Creator Responsibilities:
 
• You are solely responsible for the accuracy of event information
• You must ensure events comply with all applicable laws
• You must obtain necessary permits and permissions for physical events
• You must not create events on private property without owner permission
• You are responsible for safety and conduct at events you organize
 
Event Moderation:
 
• We reserve the right to remove or hide events that violate these Terms
• Events reported for abuse may be automatically hidden after 5 valid reports
• We may suspend or terminate accounts that repeatedly violate Terms
• We are not responsible for the conduct of events or attendees
 
Liability:
 
• We are not liable for any issues arising from events (injuries, damages, disputes)
• Event creators assume all liability for their events
• Attendees participate at their own risk
 
Event Cancellation or Changes:
 
• You must notify attendees of cancellations or material changes
• We may remove outdated or past events
• We are not responsible for notifying attendees on your behalf

9. INTELLECTUAL PROPERTY RIGHTS
 
Your Content:
 
• You retain ownership of content you create and post
• By posting content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:
  - Use, display, reproduce, and distribute your content
  - Modify, adapt, and create derivative works for service operation
  - Sublicense to third parties for service provision (e.g., hosting, CDN)
• This license ends when you delete content, except:
  - Content shared by others may remain
  - Backups may retain content temporarily (up to 30 days)
  - We may retain for legal compliance or enforcement
 
Our Content:
 
• All service features, design, logos, trademarks, and branding are our property
• You may not copy, modify, distribute, or create derivative works without written permission
• You may not use our trademarks or service marks without authorization
• "Turntopia," "Unmap," and logos are trademarks of Turntopia LLC
 
Copyright Infringement:
 
• We respect intellectual property rights
• We respond to valid DMCA takedown notices
• Report copyright infringement: admin@turntopia.net
• Include: Your contact info, description of copyrighted work, location of infringement, statement of good faith belief
• Repeat infringers will have accounts terminated
 
Trademark Policy:
 
• Do not use our trademarks in ways that suggest endorsement or affiliation
• Do not register domain names, social media handles, or business names confusingly similar to ours

10. PRIVACY AND DATA PROTECTION
 
Your use of Turntopia services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

• You have rights regarding your personal data (access, deletion, correction, portability)
• We comply with GDPR, CCPA/CPRA, and other privacy laws

Data Portability:
 
• You can export your data at any time: Settings → Account → Export Data

Account Deletion:
 
• You can delete your account at any time: Settings → Account → Delete Account
• Deletion is permanent and cannot be undone
• All your data will be deleted as described in our Privacy Policy (within 90 days)

11. LOCATION DATA
 
Location Services:
 
• Event Locations: Latitude and longitude coordinates for events you create
• Current Location: Only collected when you explicitly choose to use "Current Location" feature
• Location sharing is optional - you control when and where location is used
 
Location Data Usage:
 
• Display events on maps
• Enable location-based event discovery
• Calculate distances for filtering
• Never shared with third parties for advertising or tracking
 
Accuracy and Responsibility:
 
• You are responsible for accuracy of location data you provide
• We are not liable for inaccuracies in map data or directions
• Event attendees should verify locations independently
 
Location Privacy:
 
• Location data is removed when events are deleted
• No continuous location tracking
• No location history maintained
• You can disable location features entirely in Settings

12. USER BLOCKING AND REPORTING
 
Blocking Users:
 
• You can block users who harass or abuse you
• Blocked users cannot see your events or profile
• Blocked users cannot interact with you
• Blocking is permanent until you unblock the user

Reporting Abuse:
 
• You can report events, profiles, or content for violations
• How to report: Content → (...) Menu → Report
• Provide reason and details
• Reports are reviewed by our team
• You will be notified of actions taken (if any)
 
False Reporting:
 
• Submitting false reports is prohibited
• False reporting may result in account warnings or suspension
• We may terminate accounts that abuse reporting systems
 
What to Report:
 
• Harassment or bullying
• Hate speech or discrimination
• False or misleading information
• Spam or scams
• Inappropriate content (violent, sexual, etc.)
• Impersonation
• Copyright infringement
• Privacy violations
 
Report Anonymity:
 
• Your identity is kept confidential when reporting
• Reported users will not be notified of who reported them
 
Emergency Situations:
 
• For immediate threats to safety, contact local law enforcement first
• We cooperate with law enforcement investigations

13. CONTENT MODERATION AND APPEALS (EU DIGITAL SERVICES ACT)
 
This section applies to all users, with enhanced protections for EU/EEA/UK residents under the Digital Services Act (DSA).
 
Content Moderation Process:
 
**Automated Moderation:**
• Automated systems may flag or remove content that appears to violate Terms
• Systems use pattern recognition, keyword detection, and image analysis
• You can appeal any automated decision for human review
 
**Human Review:**
• Reported content is reviewed by trained moderators
• Complex cases may be escalated to senior reviewers
• Decisions aim to balance free expression with community safety
 
**Moderation Actions:**
• Content warning or label
• Content hiding or removal
• Account warning
• Temporary suspension (hours to days)
• Permanent ban
 
Statement of Reasons (DSA Requirement):
 
If your content is removed or restricted, we will provide:
• Clear description of what was removed
• Reason for removal (which rule was violated)
• Information about appeals process
• Whether decision was automated or human
• Notification via email and/or in-app
 
Appeal Process:
 
**How to Appeal:**
1. You will receive notification of moderation action
2. Click "Appeal" in notification or email admin@turntopia.net
3. Explain why you believe decision was incorrect
4. Provide any relevant context or evidence
 
**Appeal Review:**
• Appeals are reviewed by human moderators (not automated)
• Different reviewer from original decision when possible
• Response within 7 days for EU users, 14 days for others
• Decision is final unless new evidence is provided
 
**Possible Appeal Outcomes:**
• Content restored with no restrictions
• Restrictions reduced (e.g., warning instead of removal)
• Decision upheld (original action stands)
• Additional restrictions if new violations found
 
Out-of-Court Dispute Settlement (EU/EEA/UK):
 
If unsatisfied with our appeal decision, EU/EEA/UK residents may access out-of-court dispute settlement:
• Certified bodies: [List will be updated as certified bodies become available]
• Process: Submit dispute through certified body's platform
• Timeframe: Varies by body (typically 90 days)
• Binding: Decisions may be binding depending on body and dispute type
 
Trusted Flaggers (DSA):

• Reports from trusted flaggers receive priority review
• Trusted flagger status granted based on expertise and accuracy
 
Content Moderation Transparency:
 
• We publish transparency reports on moderation actions
• Reports include: Number of content removals, reasons, appeal outcomes

Repeat Offenders:
 
• Accounts with repeated violations may face escalating consequences
• Pattern of violations may result in permanent ban regardless of individual severity

14. USE OF AUTOMATED SYSTEMS AND AI
 
We use automated systems, algorithms, and artificial intelligence to enhance your experience:
 
Automated Systems We Use:
 
**Event Feed Ranking:**
• Determines order of events in your feed
• Based on: location, preferences, interactions, popularity, recency
• You can influence ranking by engaging with events you like
• Limited opt-out: Disable location-based ranking in Settings
 
**Event Recommendations:**
• Suggests events you might be interested in
• Based on: activity, followed users, saved events, similar user preferences
• Opt-out: Settings → Privacy → Disable Recommendations
 
**Spam and Abuse Detection:**
• Automatically flags suspicious content and accounts
• May result in content hiding or account restrictions pending review
• You can appeal any automated action (see Section 13)
 
**Content Moderation:**
• Automated filtering of inappropriate content
• Image recognition and text analysis
• Flagged content is reviewed by humans
• You can appeal decisions
 
**Search and Discovery:**
• Algorithms rank search results and discovery feeds
• Based on relevance, location, popularity, and your preferences
 
Your Rights Regarding Automated Systems:
 
• Right to know when automated systems affect you
• Right to human review of automated decisions
• Right to explanation of how decisions were made
• Right to challenge and appeal
• Right to opt-out of non-essential automated decision-making
 
**EU/EEA/UK Residents (GDPR Article 22):**
You have enhanced rights regarding automated decision-making. We do not make solely automated decisions that produce legal or similarly significant effects about you.
 
AI and Machine Learning:
 
• Our AI systems are trained on anonymized, aggregated data
• We do not use AI for high-stakes decisions (employment, credit, housing, etc.)
• AI is used to enhance user experience, not replace human judgment on important matters
 
Limitations:
 
• Automated systems may make errors
• We continuously improve accuracy
• Human oversight is always available
• You can provide feedback on automated decisions

15. ACCOUNT TERMINATION
 
Termination by You:
 
• You may delete your account at any time: Settings → Account → Delete Account
• Deletion is permanent and cannot be undone
• All your data will be deleted as described in our Privacy Policy (within 90 days)
• You can export your data before deletion
• Some information may be retained for legal compliance (e.g., financial records)
 
Termination by Us:
 
We may suspend or terminate your account if:
• You violate these Terms
• You engage in illegal activities
• You repeatedly receive valid reports for abuse
• We determine you pose a risk to other users or the service
• Your account has been inactive for extended period (2+ years) after notice
• We cease operations or are required by law
 
Notice and Process:
 
• We will provide notice before termination when possible
• EU/EEA/UK users: Statement of reasons for termination (DSA)
• Immediate termination without notice for: severe violations, illegal activity, court orders
• You may appeal termination decisions (see Section 13)
 
Effect of Termination:
 
• Immediate loss of access to your account
• Your content may be removed
• Data deletion begins (completed within 90 days)
• You may not create new accounts if banned
• License to use your content (Section 9) terminates except for content already distributed
 
Reinstatement:
 
• Suspended accounts may be reinstated if issues resolved
• Permanently banned accounts are not reinstated
• You may appeal bans via email: admin@turntopia.net
 
Service Discontinuation:
 
• We may discontinue services at any time with notice
• We will provide at least 30 days' notice before discontinuing services
• You can export your data during notice period

16. DISCLAIMERS AND SERVICE AVAILABILITY
 
Service "As Is":
 
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
 
No Warranty or Guarantee:
 
• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue features at any time with or without notice
• We are not responsible for third-party services, content, or links
• We do not guarantee the accuracy, completeness, or reliability of content
• We do not guarantee the service will meet your specific requirements or expectations
• We do not guarantee the safety, quality, or legality of events posted by users
 
User-Generated Content:
 
• We do not endorse or verify user-generated content
• We are not responsible for content posted by users
• Users are solely responsible for their own content and events
• We do not guarantee the accuracy of event information
 
Technical Issues:
 
• Service may be interrupted by: maintenance, technical issues, internet outages, force majeure
• We will make reasonable efforts to restore service promptly
• We are not liable for losses due to service interruptions
 
Third-Party Services:
 
• We use third-party services (Supabase, Twilio, Mapbox, etc.)
• We are not responsible for third-party failures or issues
• Third-party terms and privacy policies apply
 
Beta Features:
 
• Some features may be marked as "Beta" or "Experimental"
• Beta features are provided as-is without guarantees
• Beta features may be changed or discontinued at any time
 
Exceptions to Disclaimers:
 
**EU/EEA/UK/Switzerland Users:**
Nothing in this section excludes or limits warranties or guarantees that cannot be excluded or limited under applicable consumer protection laws. This section is subject to mandatory consumer protection rights in your jurisdiction.
 
**California and Other US States:**
This section does not limit rights provided by state consumer protection laws.

17. LIMITATION OF LIABILITY
 
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR LOST OPPORTUNITIES
• OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF: (A) $100 USD, OR (B) AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY)
• WE ARE NOT RESPONSIBLE FOR USER-GENERATED CONTENT OR ACTIONS
• WE ARE NOT RESPONSIBLE FOR EVENTS CREATED OR ATTENDED BY USERS
• WE ARE NOT LIABLE FOR ISSUES ARISING FROM YOUR USE OR INABILITY TO USE SERVICES
 
Not Liable For:
 
• Actions or omissions of other users
• Events, gatherings, or meetups organized through the service
• Injuries, damages, or losses at events
• Inaccurate event information
• Third-party services or content
• Viruses, malware, or security breaches not caused by our negligence
• Unauthorized access to your account if you failed to maintain security
• Service interruptions or data loss
• Reliance on any information obtained through services
 
EXCEPTIONS - WE DO NOT LIMIT LIABILITY FOR:
 
**Mandatory Legal Protections:**
 
Nothing in these Terms limits or excludes liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Gross negligence or willful misconduct
• Data protection violations under GDPR, CCPA, or similar laws
• Any liability that cannot be limited or excluded under applicable law
 
**Jurisdiction-Specific Protections:**
 
**EU/EEA/UK/Switzerland:**
EU consumer protection law prohibits limiting liability for certain matters. This limitation of liability clause does not apply to rights you have under EU consumer protection regulations that cannot be contractually waived.
 
**California and Other US States:**
Some states do not allow limitation of liability for certain types of damages. If your state law prohibits such limitations, they do not apply to you.
 
**Australia:**
Australian Consumer Law guarantees certain rights that cannot be excluded. Our liability for breach of those guarantees is limited to, at our option: re-supply of services or payment of cost of having services re-supplied.
 
**Canada:**
Limitations of liability must be fair and reasonable under Canadian law. This clause is subject to review by courts to ensure fairness.
 
Indemnification:
 
Despite limitations above, you remain responsible for indemnifying us (see Section 18).

18. INDEMNIFICATION
 
You Agree to Indemnify:
 
You agree to indemnify, defend, and hold harmless Turntopia LLC, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or related to:
 
• Your use of the services
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights (intellectual property, privacy, publicity, etc.)
• Content you post or events you create
• Your conduct toward other users
• Any events you organize or attend
• Any harm caused by your account (whether or not by you)
 
Process:
 
• We will notify you of any claim subject to indemnification
• We may, at our option, assume control of defense
• You will cooperate fully with our defense efforts
• You may not settle any claim without our prior written consent
 
Exceptions:
 
• You are not required to indemnify for claims arising solely from our gross negligence or willful misconduct
• EU/EEA/UK: Indemnification obligations are subject to EU consumer protection laws

19. DISPUTE RESOLUTION AND GOVERNING LAW

**Arbitration Agreement:**
• Disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA)
• Arbitration will be conducted in Los Angeles, California or remotely at your option
• Arbitration follows AAA Consumer Arbitration Rules
• Arbitrator's decision is final and binding
• You waive the right to a jury trial
• You waive the right to participate in class action lawsuits
 
**Class Action Waiver:**
You agree to resolve disputes individually, not as part of a class, consolidated, or representative action. Class arbitrations and class actions are not permitted.
 
**Exceptions to Arbitration:**
Either party may bring suit in small claims court for disputes within that court's jurisdiction. Either party may seek injunctive relief in court for intellectual property infringement.
